To use some aspects of the Services, you must register for an account. When registering, you agree to provide complete and accurate information and to update your information as necessary so it remains complete and accurate. Upon registration, you will choose a private username and password. You agree to use your username and password only to conduct business on behalf of yourself or the organization you represent. You will not permit others to use your username or password for any reason. Source3 will not be liable in the event of loss of your username or password or for any misuse by anyone of your username or password. You have the sole responsibility to secure and maintain your username and password and agree to immediately notify Source3 of any unauthorized use of your username and password.

6. INTELLECTUAL PROPERTY
Source3’s mission is to connect licensees and licensors at scale, facilitating the authorized production of premium content. Accordingly, Source3 values intellectual property protection. For any questions or concerns related to intellectual property associated with the Services, please contact us at firstname.lastname@example.org.
Source3 has adopted a policy to comply with provisions of the Digital Millennium Copyright Act (“DMCA”) applicable to internet service providers (17 U.S.C. § 512, as amended) (“DMCA Policy”).
Rights holders: If a rights holder believes in good faith that its copyrights have been infringed by material that has been distributed via Source3’s Services, the rightsholder may send us notice requesting that the item be removed from the Services. The notice must include the following information: (1) a physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; (2) identification of the copyrighted work claimed to have been infringed (a single notification may cover multiple copyrighted works); (3) identification of the material that is claimed to be infringing or the subject of the infringing activity, and information reasonably sufficient to allow Source3 to identify the infringing material; (4) the name, address, telephone number and email address (if available) of the complaining party; (5) a statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law; and (6) a statement that the information in the notification is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. Rightsholders may want to consult their legal advisors before issuing a take-down notice under the DMCA as there can be penalties for false DMCA claims. Source3 has adopted a policy of terminating, in appropriate circumstances and at Source3’s sole discretion, account holders who infringe the intellectual property rights of Source3 or third parties.

8. DISCLAIMERS, LIMITATION ON LIABILITY
THE SERVICES ARE PROVIDED “AS IS” AND SOURCE3 EXCLUDES TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW ANY WARRANTY, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, SATISFACTORY QUALITY OR FITNESS FOR A PARTICULAR PURPOSE.
THE FUNCTIONS EMBODIED IN THE SERVICES ARE NOT WARRANTED TO BE UNINTERRUPTED OR WITHOUT ERROR. YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION DUE TO YOUR USE OF THE SERVICES. SOURCE3 MAKES NO WARRANTY AS TO THE ACCURACY, COMPLETENESS OR RELIABILITY OF ANY CONTENT, INFORMATION, PRODUCTS, FEATURES OR MATERIALS MADE AVAILABLE ON OR THROUGH THE SERVICES.
YOU EXPRESSLY AGREE THAT YOUR USE OF THE SERVICES IS AT YOUR SOLE RESPONSIBILITY AND RISK. SOURCE3 NEITHER ENDORSES NOR IS RESPONSIBLE FOR THE ACCURACY, COMPLETENESS OR RELIABILITY OF ANY OPINION, ADVICE, STATEMENT, INFORMATION OR OTHER CONTENT MADE AVAILABLE ON OR THROUGH THE SERVICES, NOR WILL IT BE LIABLE UNDER ANY CIRCUMSTANCES FOR ANY LOSS OR DAMAGE CAUSED BY YOUR USE OF OR RELIANCE UPON ANY CONTENT, INFORMATION, PRODUCTS, FEATURES OR MATERIALS OBTAINED ON OR THROUGH THE SERVICE.
IN NO EVENT SHALL THE AGGREGATE LIABILITY OF SOURCE3, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE, WHETHER ACTIVE, PASSIVE OR IMPUTED), PRODUCT LIABILITY, STRICT LIABILITY OR OTHER THEORY, ARISING OUT OF OR RELATING TO THE USE OF THE WEBSITE EXCEED ANY COMPENSATION YOU PAY, IF ANY, EXCLUSIVE OF PUBLISHING ROYALTIES, TO SOURCE3 FOR LICENSING SERVICES OR ACCESS TO, OR USE OF, THE WEBSITE.
TO THE EXTENT IT MAY APPLY, YOU HEREBY WAIVE CALIFORNIA CIVIL CODE § 1542, WHICH STATES:
(GENERAL RELEASE – CLAIMS EXTINGUISHED) A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OS SUPSECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR.

You consent to receive communications and other agreements necessary to use the Services from Source3 electronically. You agree that all agreements, licenses, notices and other communications provided to you in electronic format satisfy any legal requirements that such documents or communications be in writing, and that such documents and communications have the same force and effect as though they had been provided in non-electronic form.
